A district court judge in the U.S. District Court, Cental Division of California, ruled that RevitaLash Advanced Eyelash Conditioner is a drug, not a cosmetic. However, Athena Cosmetics Inc., maker of the RevitaLash brand of cosmetics, says skin care facilities currently do not have to stop selling the product.
The ruling was linked to a civil lawsuit filed by Allergan Inc., which makes Latisse. The Latisse product is used to treat hypotrichosis, a condition of no hair growth. Athena issued a written statement saying it disagrees with the latest ruling, and intends to vigorously pursue its legal options.
Despite the court's ruling (patent infringement suits over eyelash enchancing drugs have been ongoing since 2007), Athena says that all RevitaLash products are safe and lawful cosmetics. Still, as a cautionary move, Athena has suspended domestic sales of RevitaLash Advanced Eyelash Conditioner until further notice. All other RevitaLash products remain available for purchase.
